To obtain the right to operate a car, a citizen must use the “Spikes” (or “Sh”) sign . He warns other car owners that studded tires are used on the vehicle. Despite the necessity, not all car owners use the sign. This is due to ignorance of existing rules. The absence of signs may raise questions from the traffic police officer. The fact is that the current legislation has undergone adjustments.

Decree of the Government of the Russian Federation dated November 24, 2018 No. 1414 abolished the driver’s obligation to install the “Spikes” identification sign on motor vehicles with studded tires. Why do you need the “Ш” sign on the car window?


The identification mark is triangular in shape with a red border, in which the letter “Ш” is inscribed in the center in black on a white background means thorns.

Changes have also occurred in the traffic rules, for example, the rule for replacing summer and winter tires, as well as the possibility of their operation, the period for replacing summer with winter tires and vice versa.

Traffic police officers are obliged to ensure traffic safety on the roads. For non-compliance with the above rule, they can issue a fine to the driver of a car without the “Ш” sign in the amount of 500 rubles.

Often, drivers of cars without the “Ш” sign, outraged by the written protocol, then go to court. There are many cases when the court acquits motorists, since a fine can be issued in case of a malfunction in the vehicle .

A sticker with the letter “Ш” is not a reason to assume that the vehicle is faulty. Still, it is better to have a “Ш” sign on the rear window, since it is recommended that all cars have one.

This is indicated in the paragraph on the admission of vehicles to operation, as well as officials who are obliged to monitor road safety.

The traffic police law on the abolition of the Ш sign - is it true?

He really is. The new law was developed back in the summer of 2018 and submitted to the State Duma for consideration in order to change the traffic rules in terms of excluding the Spikes sign from the list of those required for mounting on car windows.

The need for the sign was stated in a specially created annex to the traffic rules, which regulates the rules for allowing cars to drive on public roads. It lists the mandatory identification plates for cars, among which our notorious sign was the third paragraph:

8. The following identification marks must be installed on vehicles:

  • ….
  • “Spikes” - in the form of an equilateral triangle of white color with the top up with a red border, into which the letter “Ш” is inscribed in black (the side of the triangle is at least 200 mm, the width of the border is 1/10 of the side) - on the back of motor vehicles with studded tires tires;

The truth is that this law, abolishing the Ship sign, was adopted by the Duma as of January 27, 2022 and entered into legal force. From December 8, 2022, the obligatory sign has been abolished, and there is no obligation to affix it to the back of the car according to the Rules. Update from November 30, 2022 (outdated): on November 29, news appeared on the Internet that Medvedev abolished the obligatory sign. The corresponding resolution was indeed issued by the Russian government, but it has not been adopted and has not entered into legal force. To enter into force, a change in the traffic rules must be officially published on the legal information portal, which has not yet happened as of January 27, 2022.

Update November 5, 2022 (outdated): The government has promised soon without specifying how soon this will happen. The Duma emphasized that the innovation had previously been postponed due to more extensive changes to the traffic rules, which will be introduced by everyone at once.

No further legal acts on the abolition have been issued so far: no new laws, no official orders, decrees, resolutions and other documents.

What should the "Ш" sign look like?

According to the standard, the “Ш” sign is made in the form of a triangle with identical sides, the length of which must be at least 20 cm. The standard also establishes the width of the bordering red line, which must be exactly 0.1 of the length of the side of the triangle.

However, very few drivers think of drawing the “Ш” sign with their own hands, since with the onset of autumn it can be bought at any auto store for no more than 100 rubles.

What does this rule prove?

First, you need to remember that all such norms are spelled out in the traffic rules. Therefore, the obligation to install a tire was specified in the traffic rules. In order for any norm from this document to cease to apply, a Decree of the Government of the Russian Federation is needed. If it is not there, then amendments to the traffic rules, including those regarding cancellation, are not valid. Such a resolution has the status of making changes to the current regulatory legal act, in our case, to the traffic rules.

Was there such a resolution in the Russian Federation? Of course, it was, considering that the “Tires” sign was cancelled. If you study history, then for the first time the Resolution was submitted for consideration back in 2022, namely on 06/01/2018. The legislative act passed all the required hearings and introduced amendments, although there were some conflicts. Information appeared in the media about the entry into force of the norm on the abolition of the sign even when in fact such a norm was not in effect. For example, the document was published on the official website of the Government only on November 30, 2018. Considering that it came into force a week after publication, then this is December 8, 2018. But not November 2022, as was presented in many publications.

The amendments once again confirmed that the Government listens to the people. After all, the absurdity of installing this sign is obvious. Why does another driver or pedestrian need to know that the car has studded tires? The question is not at all clear, having previously caused a lot of controversy and confusion.

Is the Thorns sign needed in 2022?

No . As mentioned earlier, it is now necessary to install such a sign if you have winter tires with studs. The advantage is that now there will be no punishment for such a lack of identification mark. There are already all the official documents, they are presented on the portals and they should be used as a guide in making a decision.

When a sign is not required

There are situations where the absence of a sticker is generally not punishable.
Such situations can be called:

  1. The presence of Velcro. Let's imagine an abstract owner of a passenger vehicle with friction tires. They are also called “Velcro”. Although they also significantly reduce the braking distance, it becomes clear to other road users that the owner has friction tires by the absence of a triangle with the letter “W”. Such a car can slide on slippery melted ice or tightly compressed snow.
  2. Summer season. If a car enthusiast drove all winter with studded tires, and there was a sign about this on the window, he is an obedient and responsible citizen. However, in the summer you need to remove both one and the other, because the spikes on the asphalt make life difficult for others: the above pebbles become an obstacle for others, which can cause an accident.
  3. Old studded tires. This is an option that should not exist in life at all. If the spikes have long fallen off and are not on the car, the braking distance is no different from normal, but the rubber does not perform its function. This means that the sign will be useless in such a situation. The catch is that this should not be allowed, and since the Technical Regulations require changing tires on time, this must be done for traffic safety.

There are many other controversial cases where it is difficult to say where a triangle will be required and where you can safely do without it. Often the drivers themselves, wanting to find a loophole in the law, complicate their lives with such situations.

When and how to use the sign with the letter “Ш”

The studded tire sign is triangular in shape with a red border. In the center of the sign is the letter “Ш” in black on a white background . Any side of the sticker has a length of at least 20 cm. The outline of the border is taken in a ratio of 1/10 of the prescribed size of the attribute.

The sign must be affixed if the vehicle has studded tires . The sticker costs around 100 rubles. As soon as a car driver has changed his summer tires to a winter version with studs, he is recommended to stick a sign on the rear window of his vehicle.

What is the punishment?

It’s clear that there is none. If there is no obligation to install a sign, then there can be no punishment for its absence. If we do not take the time frame, then previously the penalty was 500 rubles. Another thing is that now there may be a punishment for non-compliance of tires with the standards established in the Technical Regulations of the Vehicle. But these are completely different aspects and the topic of a separate article. The inspector cannot issue a fine for the absence of a sign this year. And this is the main answer to the question posed.

Background information: even if we take the precedents of past years, an accident involving a car without the “Spikes” identification mark does not yet determine the driver’s guilt. Circumstances play a role, not identification marks.

Fine for missing a sign

Since the presence of a sticker was previously mandatory, the absence was punishable by traffic police officers. The basis for punishment can be considered Article 12.5 of the Administrative Code, which regulates the driver’s obligation to warn other road users about the characteristics of his tires. In addition, paragraph 8 of the “Regulations on the admission to operation of vehicles” states that all cars in winter must have winter tires, and in connection with this the sign “Ш”.

The absence of a sign is fraught with two types of punishment: a fine and a warning. So, a traffic police officer can simply prohibit the use of a car without a sticker. He will ask you to drive to the store closest to this place, where the corresponding spike sign is located, GOST is complied with and there is an opportunity to immediately attach it to the car.

If there are no stickers in the store, there are other types of fastenings:

  1. Velcro on the back side.
  2. Magnet – may slip a little on large potholes. It is difficult to attach such a pointer to glass, and therefore it is attached to the iron frame of the car. However, it is precisely on such details that it is not visible and the loss may not be noticed in time.

Another method of punishment is a fine. It is small, but its very presence can serve as a kind of deterrent for the driver from violating it.

The inspectorate promised not to punish

Some people once heard that the traffic police promised to punish those who do not comply with traffic rules, including in the matter of signs. But here, as always: they heard something, they twisted something, etc. In fact, the inspectorate, on the contrary, promised citizens not to draw up reports on such violators even when the corresponding Resolution on cancellation had not yet been adopted. Therefore, those fines that were issued at the time of consideration and adoption of the regulatory legal act could be easily appealed. The unspoken rule of the inspectors was not to punish.

What if I still want to stick the “Sh” sign?

There is no direct ban on warning other drivers that you have studded tires in 2022. You can put up a Spikes sign at your own discretion, and there should be no penalty for this by law.

However, pay attention to the subtlety - if you want to stick this plate on the front of the vehicle, then the prohibition of paragraph 7.3 of the Basic Provisions may apply, according to which the visibility from the driver’s seat cannot be limited. Therefore, it is prohibited to place the “Ш” sign on the windshield and front side windows.

What's the fine?

So, today there is no fine, since the Spikes sign has been canceled according to the Traffic Rules.

For violation of any paragraph from the above traffic rules appendix, a fine of 500 rubles is imposed or a warning is issued under part 1 of article 12.5 of the Code of Administrative Offenses. This provision provides for such a sanction for any violation of the provisions.

The fine for the Spikes sign could be paid at half the cost in the first 20 days after the fine was imposed (Article 32.2 of the Administrative Code). No other measures to ensure additional penalties, in addition to the main fine, for the absence of the “Ш” sign were provided for 2022. And you wouldn’t even be at fault for the accident if you didn’t have a sign installed, and another car drove into you from behind, without keeping a distance.

But the traffic police promised not to fine

Meanwhile, the traffic police commented, albeit unofficially, that there would be no fines in the winter of 2022 for the absence of the Spikes sign even before it was cancelled.

With this statement, road safety law enforcement allegedly refers to the above-mentioned draft law - while it was under consideration, and until it was adopted, the Ministry of Internal Affairs was not going to fine drivers for the absence of this sign.

The requirements for the Thorns sign relate only to the color, shape of the triangle and its size:

The question is whether it is necessary to hang up a sign of spikes if the rubber is Velcro, everything is clear, but what to do if the sign is not in stores? In accordance with traffic rules, drivers are already required to put up a sign, so its popularity has increased several times and store shelves with this product are empty. To avoid getting into an uncomfortable situation, you can make a sign at home.

For this you will need:

  1. GOST measurements - appearance and size.
  2. Self-adhesive paper with a glossy surface.
  3. Scissors and stencil paper.

The size according to GOST is: the width of each side of the triangle is at least 20 cm, and the red frame is at least 1/10 of the existing sides of the triangle. The letter Ш is inscribed in black inside an equilateral triangle. The go-ahead for making the Thorns sign at home was given immediately after the law was passed. The traffic police indicated the importance of purchasing a sign in the future, but for the first winter you are allowed to hang one you made yourself.

Homemade devices can only be used in the winter of 2022, but for next year it is better to stock up in advance in order to avoid liability for non-compliance with the rules. The Thorns sign costs about 200 rubles, which will not cause significant damage to the budget of any family. The warning symbol must be visible at a distance of 20 meters, and if the car is equipped with tinted windows, the sign Ш is posted only on the outside.

Typically, the “Spikes” sign is hung on the right side of the rear window of the car.

But its size and appearance are clearly regulated by traffic rules:

  • The length of each side must be at least 20 cm.
  • The width of the border is 0.1 of the length of the side (20 mm).

  5. Speed ​​Limit. Signs are used for vehicles subject to speed limits. This may apply to cars carrying children and to those vehicles that have such a restriction due to technical features.
  6. Dangerous cargo. The identification mark has several types. It may vary depending on what type of cargo is being transported.

  7. Large cargo. The sign is covered with a reflective surface.
  8. Slow moving vehicle. Installed on cars for which the initially permissible speed does not exceed 30 km/h.
  9. Long vehicle. Installed on vehicles longer than 20 meters.
  10. Novice driver. Installed on cars driven by drivers with less than two years of experience.
  11. Signs “Doctor” and “Disabled” are installed at will.

Do I need a thorn sign now?

From 2022, the letter “w” on a car is no longer mandatory. By decree of the Ministry of Internal Affairs of the Russian Federation, this sign was canceled. The first mention of it appeared in 1993, when the rules for the movement of vehicles on public roads in the Russian Federation were formed. Its use was determined by the technical characteristics of cars of that time and tires used for winter driving.

Modern cars are equipped with systems that affect how the car behaves in general road traffic. Studded wheel production technologies have also changed. The “Ш” sign is no longer capable of performing a warning function, since its presence makes it impossible to assess certain capabilities of the car.

Installation rules and dimensions according to standards

As has already become clear, installing the “Spikes” sign on the rear window of cars is mandatory. It is noteworthy that the same paragraph of the rules also stipulates what size the sign should be.

  • the sign must be so distinct that it can be recognized from a distance of 20 meters;
  • It is important to take into account that the sign can be read in the dark.

All these provisions are spelled out in the traffic rules “Basic provisions”, paragraph 2, second paragraph. The Road Traffic Regulations do not clearly state where exactly this identification mark needs to be affixed. The requirements include only a note that it should be “at the back”.

Although many drivers advise sticking the identification tag in the upper left corner of the rear window, it is worth considering that on some models the light will glare and the sign will not be visible.

It is very important that any stickers do not interfere with the driver of the car.

There is no consensus on whether it is necessary to remove the sign when studded tires are not in use. Since the rules do not say anything about this, each driver decides for himself whether to remove this sign or not.

It is worth considering the periods when the use of studded tires itself is permitted and even mandatory, or, conversely, prohibited.

It is mandatory to use the winter kit from December to February. This is prohibited during the summer months, that is, from June to August.

The Rules say nothing regarding the off-season. Therefore, each driver decides for himself which tires to use depending on weather conditions.

The indicator is an equilateral triangle, the sides of which cannot be less than 200 mm. They may be larger, but a large sign will often disturb the driver. The edges of the triangle are outlined with a red stripe, and inside there is the letter “W”. The red border cannot be larger than 1/10 the size of the entire sticker. Interestingly, there is no maximum size limit, but manufacturers understand that drivers will look for the smallest sizes to avoid obstructing their view.

If a person drives on non-studded tires, but leaves the “Ш” sign, he is misleading other road users.

Other drivers cannot sensibly assess how far away from the car ahead they should stay. Therefore, the sign must be removed when changing tires. If a motorist who wants to avoid a fine cannot find a sticker or does not want to go through the trouble of later removing the vehicle sign, he has the right to make the symbol himself. The sign “Ш” must correspond to the following parameters:

  • the letter Ш is located in the center and painted with black paint;

Experts advise to first study the photo of the sign. If a person does not want to make a symbol on his own, he has the right to visit specialized organizations that produce custom stickers. In this case, experts advise reminding the manufacturer of the requirements that the law places on the symbol. The use of the “Ш” sign is mandatory today. Driving on tires with studs without one will result in a fine of 500 rubles. You can purchase the sticker at any auto supply store. However, due to the increasing hype, the symbol is not always on sale. A citizen has the right to independently make the “Ш” sign. Some nuances of using the sign “Ш”

  • When buying a sticker with the image of the “Ш” sign in a store or at a car market, you need to pay attention to the size of the triangle. Its sides should not be shorter than 20 cm. A sticker that does not meet the requirements of the standard is, from a formal point of view, equivalent to the complete absence of a sign. The absence of the sign in question does not result in any penalties under the law.
The maximum that a traffic police officer can do is make a verbal recommendation. But, in some court cases, the absence of the “Ш” sign led to the driver of the car driving in front being found guilty of colliding with the vehicle behind. The traffic rules specifically state that the driver of a car is required to check and ensure that the vehicle is in good technical condition before driving. Movement is prohibited if the following defects are present:

  • Problems with the steering and braking system;
  • Inoperative headlights and side lights;
  • Driver's side window cleaner not working.

If these problems occur during transportation, the driver is obliged to eliminate them or proceed to the destination in compliance with all safety precautions. Consequently, penalties applied for the absence of the sign in question are illegal.

Explanations from the traffic police

Regarding the lack of obligation to install this sign, they gave an official response to the traffic police. However, we are talking about an old clarification - back to the date of the change in traffic rules and the abolition of the Spikes sign as such, and along with it the fine for it.

Thus, the traffic police on the official website explain that, according to Decree of the Government of the Russian Federation No. 1414, the obligation to put up a sign is excluded. This decision was made due to the lack of need to legally warn other motorists about this due to several other factors.
